TEACHER ENGAGEMENT AGREEMENT
Full Terms & Conditions
This Teacher Engagement Agreement (“Agreement”) is entered into between Encore Music (“Institute”) and the undersigned Teacher (“Teacher”).
By signing this Agreement, the Teacher agrees to the following terms:
1. Nature of Engagement
1.1 The Teacher is engaged on a freelance, per-lesson basis.
1.2 Nothing in this Agreement shall be construed as creating an employer–employee relationship, partnership, or agency.
1.3 Compensation shall be per lesson, as mutually agreed in writing.
2. Scheduling
2.1 The day and time of classes shall be mutually agreed upon between the Teacher and the Parent/Guardian and confirmed within the official communication group.
2.2 Any changes to the agreed schedule shall be communicated and acknowledged within the official communication group.
3. Teaching Responsibilities
3.1 Class Reporting
After each class, the Teacher shall submit:
i. Date of class
ii. Brief bullet points outlining topics covered
The Teacher shall maintain accurate records of songs, techniques, and concepts taught.
Quarterly progress reports shall be submitted if requested by the Institute.
3.2 Curriculum & Academic Alignment
The Institute shall provide a curriculum framework based on student level and academic planning.
The Teacher shall follow the framework and align with Institute direction where required, including adjustments based on parent feedback or academic review.
For clarification regarding foundational technique or repertoire selection, the Teacher shall consult the Institute where necessary.
3.3 Assessments
Students shall undergo periodic tests and annual examinations.
The Teacher shall notify the Institute when a student is ready for assessment.
Assessment materials and schedules shall be issued by the Institute.
Assessment reports must be submitted upon completion.
4 Trial Lessons
Trial lessons shall be 30 minutes unless otherwise specified.
A brief written report shall be submitted after completion.
5. Professional Conduct
The Teacher shall:
5.1 Maintain professional standards in speech, behaviour, attire, and hygiene.
5.2 Avoid political, religious, or ideological discussions during class.
5.3 Use appropriate language at all times, particularly when teaching minors.
5.4 Refrain from smoking immediately prior to class.
5.5 Avoid non-essential phone usage during sessions.
5.6 Not offer food or beverages to students.
5.7 Student Privacy
The Teacher shall not photograph, record, or store student media on personal devices.
If recording is required for academic purposes, the parent’s or student’s device must be used.
5.8 Child Safety & Supervision
A responsible adult must be present during home lessons involving minors.
If no responsible adult is present, the session shall not be conducted.
If a child displays distress or shares information of concern, the Teacher shall immediately inform the parent and notify the Institute.
5.9 Identification
The Teacher shall carry a valid government-issued identification while conducting lessons and comply with premises entry requirements where applicable.
6. Safety & Liability
6.1 The Teacher shall exercise due care while conducting lessons at client premises.
6.2 Any damage caused due to negligence shall be borne by the Teacher.
6.3 The Teacher shall ensure students remain away from unsafe areas or hazards during sessions.
7. Attendance & Punctuality
7.1 The Teacher shall be punctual for all scheduled sessions.
7.2 Repeated complaints (two or more within a month from the same student) regarding late arrival may result in review and appropriate action, including fee adjustment or reassignment.
7.3 If delay is communicated in the official communication group and accepted by the parent/student, the matter shall be deemed resolved.
7.4 Failure to attend a scheduled class without prior notice shall constitute serious professional misconduct.
7.5 If a student is unavailable without prior notice, the session shall be treated as payable.
8. Notice Period
The Teacher shall provide a minimum of thirty (30) days’ written notice before discontinuing instruction of an assigned student.
9. Non-Solicitation
The Teacher shall not directly or indirectly solicit, engage, or continue teaching any student introduced through the Institute outside the Institute’s structure.
Breach of this clause shall result in immediate termination of engagement and may invite further legal action.
10. Events & Performances
The Teacher may be invited to participate in performances, workshops, or related academic events.
Such engagements shall be compensated separately, where applicable.
11. Replacement Rights
The Institute reserves the right to reassign a student in cases of academic misalignment, quality concerns, or operational requirements.
12. Police Clearance Certificate (PCC)
12.1 The Teacher shall apply for a Police Clearance Certificate.
12.2 Without submission of PCC, the Teacher may be limited to a maximum of two students.
12.3 Submission of PCC is mandatory to receive additional students or conduct regular home lessons.
13. Payment Terms
13.1 Payment shall be processed within the first seven (7) days of the following month.
Example: Lessons conducted in January shall be paid by 7th February.
13.2 Payments are subject to confirmed attendance and receipt of student fees by the Institute.
14. Confidentiality & Data Protection
14.1 All student, parent, and Institute information shared during engagement is confidential.
14.2 Contact details shall be used strictly for professional purposes during active engagement.
14.3 Upon disengagement, all related data shall be deleted and shall not be retained or reused.
14.4 Institute processes, curriculum frameworks, and internal systems are proprietary and confidential.
15. Policy Amendments
The Institute reserves the right to amend policies or procedures. Written communication of such amendments shall be binding for continued engagement.
16. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India.
Jurisdiction shall be Mumbai, Maharashtra.
17. Termination
The Institute reserves the right to terminate engagement in the event of:
Breach of this Agreement
Professional misconduct
Repeated negligence
Violation of Institute policies
Non-solicitation breach
ANNEXURE A
Late & Cancellation Policy
1. Teacher Cancellation
1.1 One cancellation per student per month is permitted, provided prior notice is given.
1.2 A minimum of 3 hours prior notice must be provided to both the Institute and the student.
1.3 Efforts shall be made to reschedule the session.
1.4 Repeated last-minute cancellations may result in review.
2. Client Cancellation
2.1 If cancellation occurs within two (2) hours of scheduled class time, the session shall be fully payable to the Teacher.
2.2 Rescheduling discussions shall occur within the official communication group.
3. Communication Protocol
3.1 The Institute shall create an official WhatsApp group including Teacher, Parent/Guardian, and Admin.
3.2 Scheduling and class-related communication shall take place within this group.
3.3 Once a reschedule is agreed, the Teacher shall confirm within the group for portal update.
3.4 The Teacher shall send a confirmation or reminder message in the official communication group on the day of the scheduled class prior to commencement of the session.
